Fchem (Aust.) Limited

A non-trading subsidiary of Nufarm Limited, Fchem (Aust.) Limited, was yesterday one of a number of parties served with an application and statement of claim on behalf of the Australian Competition and Consumer Commission (ACCC).
The application relates to alleged price fixing and other activities involving the timber protection industry. Nufarm’s interests in the timber protection industry were sold to Osmose Australia Pty Ltd in January 2001.
The allegations against Fchem (formerly Fernz Australia Limited) relate to the sale of certain timber preservative products in the period 1998 – 2000.
The Nufarm group is no longer involved in the timber protection industry and the ACCC has not alleged any contraventions by current Nufarm management.
A number of companies and executives engaged or formerly engaged in the timber protection industry are also respondents to proceedings brought by the New Zealand Commerce Commission (NZCC) in the New Zealand High Court. Those proceedings were disclosed to the market in an announcement by Nufarm on April 22, 2005.
Nufarm and its legal advisers are examining the application and the statement of claim and will conduct a thorough investigation of the allegations made.
