Burr Ridge, Illinois - Nufarm Americas Inc. announced today that it is well prepared to vigorously defend allegations by Bayer CropScience in a lawsuit against Nufarm Americas Inc. for claimed infringement of Bayer’s U.S. Patent No. 5,783,203 on the combination of Imidacloprid plus fertilizer plus adhesive. This lawsuit is specific to Imidacloprid combinations with fertilizer and in no way implicates Mallet™ 2F, Mallet™ Granular Insecticides or other Nufarm products. Nufarm reaffirms its continued commitment to strongly support its customers and sales of Mallet™ 0.2% on Fertilizer to the market.

Nufarm's turf formulator customers recognize this strength in Nufarm and once the Imidacloprid molecule patent expired, they had confidence in Nufarm to develop new and improved solutions to an outdated and cumbersome process of applying dry Imidacloprid on fertilizer.
Nufarm fully respects intellectual property rights and performs extensive due diligence to ensure any product it develops does not infringe on any third party’s patents. Nufarm identified a market need to improve the process of applying Imidacloprid to fertilizers and granules and developed a user friendly solution that Nufarm firmly believes does not infringe Bayer’s U.S. Patent No. 5,783,203; does not require an adhesive and is easier, more efficient and cleaner to use. Nufarm's solution allows the turf product formulators to practice the well established spray impregnation technique to apply liquid Imidacloprid on fertilizers and granules. These products are registered and branded as Mallet™ 0.2% on Fertilizer and a range of Mallet™ Granular Insecticides. This well accepted application technique is similar to that used in Nufarm’s successful Triamine®, Dissolve® and Millennium Ultra™ turf herbicide products.
